(1) Whose names appear on the April 4, 2003 membership roll of the Samish Indian Nation; or

(2) Who are descendants of members of the Samish Indian Nation at the time the Treaty of Point Elliott was signed on January 22, 1855, or who are descended from those Nhuwhaha families identified in the Final Determination to Acknowledge the Samish Tribal Organization as a Tribe, dated November 8, 1995, p. 12; or

(3) Born to any member of the Samish Indian Nation.

Any person who does not meet the membership requirements of this section shall not be enrolled as a member of the Samish Indian Nation.
