(1) Any person elected to tribal office in the Samish Indian Nation is subject to recall from office upon petition of one-quarter (1/4) of the General Council. A recall petition shall be submitted to the Election Board before circulation.

(2) Upon receipt of a recall petition, the Election Board shall verify the authenticity of the petition signatures, using tribal records. The Election Board shall notify the Tribal Council in writing that a sufficient number of petition signatures have been verified, at which time a special election to consider the recall of the named tribal official shall be set by the Election Board within thirty (30) days.

(3) A recall election shall be conducted by mail. A simple majority of those voting shall result in the recall of the named tribal official, at which time the position of the official shall be declared vacant and filled in accordance with Article VIII, Section 5 of this Constitution. An explanation of the reason why recall is being sought may be included by petitioners. Any Tribal Council member named in a recall petition shall not take part in any action or discussion related to such recall, but said member shall have the right to have a statement explaining his or her conduct be included with the recall election ballots.
