The referendum process allows the Tribal Council to refer proposed legislation to the General Council for its binding vote, and allows the General Council, on its own, to uphold or overturn legislation that has been passed by the Tribal Council. Upon receipt and verification by the Election Board of a petition of at least one-quarter (1/4) of the General Council of the Samish Indian Nation, or upon the resolution of at least five members of the Tribal Council, any proposed or enacted ordinance or resolution of the Tribal Council shall be submitted to a vote of the General Council at a regular or special election to be held within sixty (60) days of the date the Election Board notifies the Tribal Council in writing that a sufficient number of petition signatures have been verified or of the vote required of the Tribal Council. A majority of those actually voting in the referendum shall cause the ordinance or resolution being voted on to be rescinded and shall be conclusive and binding on the Tribal Council, provided, that at least one-third (1/3) of the General Council cast ballots in such election.
