(1) In the event the elective tribal office of Tribal Chair shall become vacant between elections, the Vice-Chair shall assume the office of Tribal Chair, and shall serve the remaining term for that position.

(2) In the event the elective tribal office of Tribal Vice-Chair, Secretary, or Treasurer becomes vacant between elections, the members of the Tribal Council shall elect from their membership a Tribal Council member to assume the vacant officer position, who shall serve the remaining term for that position.

(3) In the event the position of a Tribal Council member becomes vacant between election, through accession of that member to a Tribal Council officer position, resignation, removal, death or otherwise, the members of the Tribal Council shall vote to fill the Tribal Council member position from interested General Council members who express an interest in filling the vacant position and who otherwise meet the requirement of a candidate for that position. The person who receives a majority of votes of Tribal Council members for the position shall assume office to serve the remaining term for that Tribal Council position. In the event no nominated person receives a majority, the candidates receiving the two highest vote totals shall be subject to another vote, with the person receiving the most votes assuming the vacant position. In the event of a tie, the Chair shall select one of the two nominees to fill the vacant position.

(4) In the event any vacancy or combination of vacancies results in less than four (4) sitting members of the Tribal Council, the Election Board shall set a special election within forty-five days to fill the vacant positions. Tribal members shall be notified of the vacancies, and members who meet the qualifications for office shall have fifteen (15) days to announce their candidacies. The special election shall be conducted by the Election Board. Upon certification of the election, the persons receiving the most number of votes for each vacant officer position shall assume office to fill the vacant officer position for the remainder of the term. Tribal Council member positions shall be assigned in such special election according to remaining length of term, with the person receiving the most votes assuming the Tribal Council member position with the longest remaining term, and so on through the list of successful candidates.
