The following definitions apply wherever these terms are used throughout the Samish Tribal Code:

BIA” means the Bureau of Indian Affairs within the United States Department of the Interior.

Samcor” means SAMCOR, Incorporated, the economic development arm of the Samish Indian Nation. Samcor is a federally chartered corporation organized, incorporated and granted its corporate powers, privileges and immunities under 25 U.S.C. § 477 (now § 5124), and a distinct legal entity wholly owned by the Samish Indian Nation.

Samcor Board” means the SAMCOR, Incorporated Board of Directors.

Samish BIA Service Area” means the area designated by the BIA as appropriate for the provision of BIA financial assistance and social services for the Samish Indian Nation and consists of Island, San Juan, Skagit, Snohomish, and Whatcom Counties.

Samish citizen” means an enrolled citizen of the Samish Indian Nation.

Samish Indian Country,” consistent with the meaning given in 18 U.S.C. § 1151, means:

(a) All land under the jurisdiction of the Samish Indian Nation, including rights-of-way running through the same;

(b) All Indian allotments or other lands held in trust for a Samish Indian Nation Tribal member or for the Samish Indian Nation, the Indian titles to which have not been extinguished, including rights-of-way running through the same; and

(c) Any formal or informal reservations, including Tribal trust land considered as an informal reservation under federal law.

Tribal Council” means the duly elected governing body of the Samish Indian Nation under the Tribe’s Constitution.

Tribal Court” means the Samish Tribal Court, including the Samish Community Law Court, the Samish District Court, the Samish Court of Appeals, and the Samish Family Court.

Tribe” or “Tribal” means and refers to the Samish Indian Nation. [Res. 2020-04-005 § 1, 2020; Res. 2020-04-003, 2020; Res. 2019-12-033 § 8, 2019.]
