(1) Laws.

(a) The Tribal Council may establish laws for the Samish Indian Nation by ordinance.

(b) Individual ordinances are organized and codified into the Samish Tribal Code, which may be referred to as the “Samish Tribal Code” and abbreviated “STC.”

(c) The Samish Tribal Code is prima facie evidence of the laws of the Samish Indian Nation.

(2) Policies.

(a) The Tribal Council may establish policies for the operation of the government of the Samish Indian Nation by resolution.

(b) Individual resolutions are organized into the Samish Tribal Policies, which may be referred to as the “Samish Tribal Policies” and abbreviated “STP.”

(3) Distinguishing Between Laws and Policies. Both laws and policies are adopted by Tribal Council, and a flexible threshold exists between what Tribal Council may designate a law or a policy.

(a) A regulation that affects the rights and privileges of a tribal member is a law, and properly adopted by ordinance.

(b) A regulation that implements a law of the Tribe, or applies only to tribal staff or operations of the government staff, is a policy, and is properly adopted by resolution. [Res. 2019-12-033 § 8, 2019.]
