(1) Title. The program established in this chapter may be referred to as the “Funeral Assistance Program.”

(2) Purpose.

(a) The purpose of this program is to provide assistance to the families of deceased tribal citizens and implement the provisions of 25 CFR 20.324 through 20.326.

(b) It is not the intent of this code to dictate how or where to bury, cremate, or entomb a deceased tribal citizen or how to conduct the funeral; the intent is to articulate which costs will be paid for directly or reimbursed.

(3) Limitations.

(a) The assistance available under this program has different qualifications based on the funding source.

(b) The benefits outlined in this chapter do not apply to tribal citizens who have died prior to the effective date of this chapter.

(4) Administration. The Tribal Enrollment Office shall administer these benefits. [Res. 2020-04-003, 2020.]
