(1) Ballot Counting. A tribal voter may request to be present when election ballots are counted. A tribal voter’s presence in the room where the ballots are counted is subject to procedures adopted by the Election Superintendent to ensure that no tampering of the ballots occurs and that the ballots are counted in an efficient manner.

(2) Recount Requests. A tribal voter may make a request for a recount of the ballots in an election to the Election Superintendent. A recount request must be made after all valid ballots have been counted and the results certified by the Election Superintendent, but before the winning candidates are sworn in or the initiative or the results of a recall election take effect. A fee of $100.00 must be presented to the Election Superintendent at the time the request is made.

(3) Appeals. Any final decision of the Election Board, including certification of any tribal election, or the Tribal Council under this chapter may be appealed to the Tribal Court under the rules of appellate procedure. An appeal of a final decision under this chapter must be filed within 15 days of the decision. [Res. 2020-01-005 § 2, 2020.]
