(1) When Available. In any case where the Tribal Council determines that it is in the best interests of the Tribe to intervene in pending state court proceedings involving custody of a child who is not enrolled in the Samish Indian Nation, but who may be eligible for citizenship, the emergency procedures set forth below must be followed.

(2) Process. The Enrollment Committee shall determine whether the child is eligible for citizenship as soon as possible. If the child is otherwise eligible for citizenship per STC 2.10.010(2) but the parent(s) has not enrolled the child, the Social Services Indian Child Welfare worker shall file an application on behalf of said child and, if the application otherwise meets the criteria established by this chapter, all time limitations and posting requirements of this chapter are waived.

(3) No Waiver. Nothing herein shall be construed to waive the provisions of STC 2.10.050(4) or the right of the Council to modify blood quantum under STC 2.10.050(4). [Res. 2023-09-003 § 1, 2023; Res. 2020-04-011 § 2, 2020.]
