(1) Applicability. This chapter applies within Samish Indian Country, including to the commercial activities of the Tribe on its fee land. Compliance with this chapter is hereby made a condition of the use of any land or premises in Samish Indian Country.

(2) Deemed to Consent. Any person who resides on, conducts business within, engages in a business transaction within, or enters Samish Indian Country, who receives benefits from the Tribal government, including police, fire or emergency services, or who acts under Tribal authority, shall be deemed thereby to have consented to the following:

(a) To be bound by the terms of this chapter;

(b) To the exercise of jurisdiction by the Tribal Court over said person and any property in the possession, custody and control of said person, in legal actions arising pursuant to this chapter; and

(c) To detention, service of summons and process, search and seizure and forfeiture of property in conjunction with legal actions arising pursuant to this chapter.

(3) Business License Required.

(a) Except as provided in STC 6.10.050(2), no person shall conduct business within Samish Indian Country without having first obtained and having currently in force a business license issued by the Samish Indian Nation pursuant to STC Chapter 6.10. Provided, that no business license shall be issued to any person who at the time of the requested issuance shall owe to the Samish Indian Nation any taxes imposed by this chapter.

(b) All persons desiring to conduct business within Samish Indian Country shall appoint an individual to act as a registered agent for the business for the purpose of service of process for any action arising out of the conduct of that business.
