(1) Samish lands under the jurisdiction of the Samish Indian Nation were established for the use and benefit of the Samish Indian Nation and are within the ancestral and aboriginal territories of the Samish people as recognized by the Treaty of Point Elliott.

(2) The Samish Indian Nation, through its governing body, the Samish Tribal Council, pursuant to Article VI of the Samish Constitution has the jurisdiction and the duty to protect the natural resources within the boundaries of the Samish lands under the jurisdiction of the Samish Indian Nation.
