(1) Closed to gathering” means any place described or designated by this chapter or by regulation where it is unlawful to gather, or any plant species described or designated by regulation that is unlawful to gather.

(2) Gathering limit” means the maximum amount of plant material which may be gathered or possessed by any person, specified by ordinance or regulation, for any particular period of time.

(3) Game Agent” means any person authorized to enforce this chapter or a regulation and includes persons authorized to enforce STC Chapter 7.10 (Hunting).

(4) Gather” and its derivatives means the collecting, harvesting, picking, or taking of plant material under this chapter.

(5) Gathering permit” means and refers to a permit issued by the Samish Indian Nation pursuant to this chapter authorizing the Samish Tribal citizen named on that permit to engage in gathering under this chapter.

(6) Plant material” means any material derived from any species of plant or fungus for subsistence, medicinal, ceremonial or other traditional or cultural purposes, including but not limited to grasses, rushes, barks, woods, gourds, stems, roots, seeds, berries, and leaves. As used in this chapter, “plant material” also includes any other naturally derived material used in conjunction with material derived from a plant or fungus species, including but not limited to red or black clay.

(7) Regulation” means any rule or regulation promulgated pursuant to this chapter by the Natural Resources Committee and approved by the Samish Tribal Council.

(8) Revocation of gathering privileges” means the recall of all rights and privileges granted to an individual Samish Tribal citizen by a gathering permit issued by the Samish Indian Nation under this chapter. [Res. 2020-12-039, 2020.]
