Gathering by Tribal citizens within areas under the jurisdiction of the Samish Indian Nation, within Tribal lands, and within all open and unclaimed lands as provided in the Treaty of Point Elliott is permitted unless an area or plant species has been closed to gathering or the gathering season has been modified by regulation; provided, that Tribal citizens must first obtain a Tribal gathering permit pursuant to STC 7.11.160 (Required Identification and Permits) before gathering plant material under this chapter.
