(1) All lands within the jurisdiction of the Samish Indian Nation including lands held in trust by the United States for the Samish Indian Nation and lands owned in fee by the Samish Indian Nation are closed to gathering by persons ineligible to exercise rights under this chapter unless such ineligible persons have received permission from the Tribe to engage in gathering pursuant to STC 7.11.150 (Gathering by Non-Citizen).

(2) Where the Samish Indian Nation has entered into a gathering agreement with the Bureau of Land Management, National Park Service or United States Forest Service, the terms of that agreement shall govern gathering by citizens on land subject to that agreement. Where the Samish Indian Nation has not entered into an agreement governing gathering on land managed by the Bureau of Land Management, National Park Service or United States Forest Service, gathering on such land will be generally closed except as opened by the Tribe.

(3) Gathering within any area closed to public access due to extreme fire danger by the United States Forest Service or the Washington Department of Natural Resources is closed.

(4) Any gathering on lands managed by the Washington State Department of Natural Resources must also be in accordance with the Samish Indian Nation’s gate access agreement with that agency. [Res. 2020-12-039, 2020.]
