(1) Eligibility for Treaty Gathering. Only citizens of the Samish Indian Nation may exercise gathering rights pursuant to the Tribe’s rights under the Treaty of Point Elliott of 1855.

(2) Gathering by Minor Citizens. It is the duty of the parent or guardian of any minor citizen who exercises treaty gathering rights to ensure compliance with this chapter. No minor citizen shall be issued a Tribal gathering permit without the signed consent of his or her parent or guardian. Said consent shall clearly indicate the duty of the parent or guardian to ensure compliance with this chapter. The parent or guardian who permits a minor to gather under this section shall be subject to prosecution for violation of this chapter. [Res. 2020-12-039, 2020.]
