(1) In General.

(a) Samish citizens purporting to exercise treaty gathering rights shall obtain an annual Tribal gathering permit from the Samish Department of Natural Resources. All such permits shall be nontransferable and shall expire on April 30th of each year. The Tribal gathering permit shall also serve as a reporting card for gathered material as provided in STC 7.11.170 (Offenses).

(b) Any person gathering shall produce for examination the applicable identification cards and gathering permits required by this section upon demand of any Tribal, local, state or federal law enforcement official. Failure to produce the required forms of identification shall be probable cause to believe that such person is not authorized to exercise Tribal gathering rights.

(c) All identification cards and permit documents issued by the Samish Indian Nation shall remain the property of the Samish Indian Nation and shall be returned to the Tribe upon order of the Tribal Court or as otherwise provided in this chapter.

(d) No Tribal gathering permit shall be issued for a given year unless and until the gatherer has paid all Tribal fines for gathering violations levied during previous seasons.

(2) Ceremonial Gathering. Only citizens of the Samish Indian Nation shall exercise ceremonial gathering rights. Citizens gathering for ceremonial purposes shall have in their possession a current Tribal gathering permit as provided in STC 7.11.120 (Gathering for Ceremonial Use). Each ceremonial gatherer shall report his or her ceremonial take to the Natural Resources Committee as provided in the permit.

(3) Required Identification for Tribal Citizen Minor. Minors who are citizens of the Tribe and are purporting to exercise treaty gathering rights under this chapter must have in their possession the permit issued to them pursuant to the provisions of this chapter. [Res. 2020-12-039, 2020.]
