(1) Filling an Existing Vacancy. When a current position becomes vacant, the appropriate member of the Chief Executive Team will determine whether the position will be filled based upon its function and availability of funding for the position. If the position will be filled, the appropriate member of the Chief Executive Team authorizes the Senior Human Resources Officer to post the position.

(2) Filing New Job Positions. When a new position is created within Tribal Administration, the position shall be filled in the same manner as any existing, vacant position is filled.

(3) Temporary Vacancies. The appropriate member of the Chief Executive Team shall have authority to fill temporary vacancies that do not exceed 180 days without following STP 5-03-003 or 5-03-004. For any position which will remain temporarily vacant for more than 180 days but which must be filled, including but not limited to vacancies pursuant to maternity or paternity leave, prolonged illness, or other unscheduled long term absence, the appropriate member of the Chief Executive Team must follow the procedures for filling an existing vacancy.

(4) Reduction in Force. Employees whose employment ended because of a reduction in force will be notified of positions and shall be granted a preference for rehire for one year following the date of their termination of employment. The regular hiring procedure need not be followed if the former employee is qualified for the position. The provisions of STP 5-02-001(1)(c) apply to an employee rehired under this provision.
