(1) Accrual of Annual Leave: Regular Employees. Regular full-time Tribal employees will accrue annual leave based on their length of continuous employment with the Tribe, as follows:

Up to 2 years, hired prior to 12/14/12

104 hours

Up to 2 years, hired after 12/14/12

80 hours

2 to 5 years

130 hours

Over 5 years

160 hours

Regular part-time Tribal employees will accrue prorated annual leave based on the number of hours worked compared to the full-time equivalency. Employees who are transferred, promoted or accept another position within Tribal Administration will maintain their current hourly leave balance.

(2) Limit on Carry-Over Accruals. Employees may carry over up to 160 hours of annual leave from calendar year to calendar year. Any leave in excess of 160 hours must be used in the current calendar year or it will be lost as of January 1st of the next year. Regular employees will be paid for accrued and unused annual leave upon termination of employment; provided, that no employee will be paid more than 160 hours of accrued leave upon termination of employment.

(3) Notification of Use of Annual Leave. Each Tribal employee will provide his or her supervisor reasonable advance notice of planned absences, and will obtain the approval of their immediate supervisor before taking annual leave.

(4) Accrual of Leave for Reemployed Employee. Upon reemployment, an employee whose termination with the Tribe was caused by a layoff or reduction in staff will continue to accrue annual leave at the same rate as before he or she left, if the employee is reemployed within 12 months after the layoff. An employee who voluntarily terminates employment with Tribal Government and is subsequently rehired will be considered a new employee. [Res. 2022-10-016 § 1, 2022.]
