(1) Accrual of Sick Leave. Regular full-time Tribal employees accrue sick leave at the rate of eight hours per month. Regular part-time Tribal employees will accrue prorated sick leave based on the number of hours worked compared to the full-time equivalency. Accrued sick leave will not be paid an employee upon termination. Sick leave is authorized only for medical necessity relating to the employee or an employee’s immediate family member and may be used for the following purposes only:

(a) Illness;

(b) Appointments with health care providers;

(c) Hospitalization or out-patient treatment; or

(d) Quarantine based on exposure to contagious disease, when documented by a physician’s statement.

(2) Notification of Use. Each Tribal employee will notify his or her direct supervisor as soon as possible after the need for sick leave is known. The supervisor may require the employee to substantiate, by doctor’s letter or similar document, that the sick leave is necessary. Sick leave of five days or more duration shall require documentation by a doctor.

(3) Conversion of Accrued Sick Leave. Sick leave in excess of 320 hours may be converted, at a 4:1 ratio, to annual leave time. Converted sick leave hours may only be used for annual leave and may not be converted for reimbursement purposes upon termination.

(4) Disallowance of Sick Leave. In addition to imposing disciplinary sanctions for abusing sick leave, the appropriate Chief Executive Team member may disallow sick leave unwarranted under this section and either charge it against an employee’s annual leave or consider it leave without pay. An employee in lieu of annual or other personal leave may not use sick leave. In cases where excessive absences of an employee are determined to be negatively impacting work performance, clients, the work site, or Tribal Government, the appropriate Chief Executive Team member may terminate the employee.

(5) Accrual for Transferred or Promoted Employees. Employees who are transferred, promoted, or accept another position within Tribal Administration will maintain their current hourly sick leave balance, but will not accrue additional hours during any period when they were not employed.

(6) Voluntary Donation of Sick Leave. If an employee has in excess of 100 hours of accrued sick leave, the employee may donate any hours over 100 hours of sick leave to another employee pursuant to the provisions of this chapter. [Res. 2022-10-016 § 1, 2022.]
