(1) Holidays. The Samish Indian Nation shall recognize and observe as paid the following holidays:

(a) New Year’s Day.

(b) Treaty of Point Elliot signing.

(c) Memorial Day.

(d) Independence Day.

(e) Labor Day.

(f) National Indian Day (fourth Friday of September).

(g) Veterans Day.

(h) Thanksgiving Day and the following Friday.

(i) Christmas Eve Day through New Year’s Day.

On the observance of these holidays by Tribal Government, all Tribal offices will be closed. In addition to the above holidays, the Tribal Council may close Tribal offices for other official holidays or commemorations.

(2) Calculation of Holiday Leave. Full-time regular Tribal Employees will receive eight hours of pay for Tribal holidays. Part-time employees will receive pay for the number of hours they would have otherwise worked if the holiday occurs on their regular workday.

(3) Regular Employees on Leave Without Pay. Employees that are on leave without pay before or after the holiday shall not receive holiday pay.

(4) Pay for Working Official Holidays. If a nonexempt employee is required and authorized in writing by a supervisor to work on an official Tribal holiday, the employee will either be paid at time and a half or receive equal time off for time worked on the holiday, not to exceed eight hours. The employee shall take the equivalent amount of time off during the same pay period. Tribal employees are not encouraged to work on Tribal holidays. If they work without being required or authorized to do so in writing, no additional compensation will be provided.

(5) Observation Date of Holidays. Tribal holidays will be observed on the same date such holiday is observed by the Federal government or on a date designated by the Tribal Council. If the Tribal holiday falls on a Saturday, it will be observed the previous Friday. If the Tribal holiday falls on a Sunday, it will be observed the following Monday. [Res. 2022-10-016 § 1, 2022.]
