(1) A supervisor who believes that discharge of an employee is justified will document the reasons for discharge and submit them to the appropriate levels of supervision for review.

(2) If discharge is approved by the appropriate Chief Executive Team member:

(a) The Senior Human Resources Officer will complete a personnel action form and notify the Information Technology Department of the discharge so that the appropriate steps can be taken to secure Tribal electronic data and equipment.

(b) The Senior Human Resources Officer will also ensure the employee’s final time sheet is forwarded to the Accounting Department for preparation of the employee’s final paycheck.

(c) The supervisor shall ensure that all Tribal property has been returned by the discharged employee.

(d) The Accounting Department will ensure that advances have been collected and/or accounted for, annual leave has been calculated, and any amounts due the Tribe have been withheld from the final payroll check prior to issuing the final paycheck.

(i) An employee who refuses to return Tribal property will have the value of the property and incidental expenses deducted from the employee’s final paycheck; provided, that the Tribe may demand the return of property in lieu of deducting the value thereof or take appropriate legal action to recover the property, including referring the matter to the appropriate law enforcement authorities.
