(1) Administrative Review.

(a) A person who receives a notice of denial under STC 10.20.160 may request administrative review of that denial by the PRC Resource Panel. The request must be submitted:

(i) By the patient or guardian/representative;

(ii) To the PRC Resource Panel; and

(iii) Within 30 days of the date of the denial letter.

(b) A person who submits a request for administrative review may request an advocate from the Health and Human Services Department. The advocate may write an opinion to the PRC Resource Panel based on review of the patient’s extenuating circumstances.

(c) The PRC Resource Panel, by majority vote, must uphold, reverse, or modify the decision of the Samish Health Director, or may extend PRC services for six months.

(d) The PRC Resource Panel will have 30 days to make its decision from the date of receipt of the request for administrative review.

(e) A request for reconsideration must contain additional information not previously submitted.

(2) Appeal to the Samish Appeals Board.

(a) If a denial is upheld by the PRC Resource Panel, the patient may appeal to the Samish Appeals Board.

(b) A person must exhaust their administrative remedies by seeking review by the PRC Resource Panel in order to appeal to the Samish Appeals Board.

(c) A decision of the PRC Resource Panel is considered a final decision of the department for the purpose of appeal under STC Chapter 1.80. [Res. 2020-10-013 § 2, 2020.]
