(1) The Director shall deliver a written decision to Council and the applicant either denying, approving, or approving a development permit application with conditions/mitigation measures. The Director’s decision shall be an appealable final decision under this title.

(2) If the development permit application is granted, the decision shall include the boundaries of the trust or reservation land where the development activity is to occur, any needed easements or rights-of-way running through the trust or reservation land, and any necessary installation of infrastructure (including but not limited to streets, water, stormwater, electrical, and wastewater).

(3) All final decisions on a development permit application shall be an appealable final decision for purposes of this title, but appealable only by the provisions within this title. [Res. 2023-09-004 § 1, 2023; Res. 2021-11-001 § 7 (Att. A), 2021.]
