(1) In General. Penalties listed for each offense herein apply to an individual’s first violation of this chapter. The Tribal Court shall not suspend or reduce any minimum penalty under this chapter. Samish citizens adjudged to have violated this chapter shall have their gathering privilege revoked until all court fees and penalties are fully satisfied.

(2) Repeat Offenses. Any person who is adjudged to have committed a second or subsequent violation of this chapter (whether the same or a different offense) within five years of the first violation shall be subject to the following penalties:

(a) Unless otherwise specified, the penalty shall be a minimum, mandatory fine in an amount which is twice the mandatory minimum fine for a first violation for that offense, with a maximum fine of $500.00.

(b) If the second infraction is for violating STC 7.11.170(2) (Gathering During Closed Season) or 7.11.170(5) (Exceeding Gathering Limits), the sentence shall be the same as subsection (2)(a) of this section, and revocation of all gathering privileges for no less than one year and not to exceed three years.
