(1) The Samish Indian Nation adopts the substance of the edition of the Washington State Department of Ecology’s Stormwater Management Manual for Western Washington in effect throughout western Washington as the substantive stormwater management manual for Samish Indian Country; provided, however, that Samish Tribal Law and process shall govern application and use of the manual in Samish Indian Country, and the laws and regulations of the State of Washington associated with the manual shall not apply within Samish Indian Country except as specifically provided in this chapter. A hyperlink to the Stormwater Management Manual will be posted on the Planning Department’s webpage.

(2) When deemed appropriate and relevant by the Director, an applicant shall submit a stormwater site plan to the Department consistent with the Stormwater Manual and receive approval prior to commencing development activity.
