(1) Tribal Seal.

(a) Except as authorized by the Tribal Council, no person shall knowingly use any device or possess any device capable of such use to emboss upon a document or other object the seal of the Samish Indian Nation.

(b) No person shall knowingly use any reproduction of the tribal seal:

(i) In any manner falsely implying official endorsement or sponsorship by the Samish Indian Nation, its Tribal Council, or any of its departments or entities of any product, business, service or other activity; or

(ii) In any manner that subjects or exposes the tribal seal to ridicule, debasement or infamy.

(c) The seal of the Samish Indian Nation shall not be used for any commercial purpose or gain by any individual or entity.

(2) Tribal Logo. Except as authorized by Tribal Council, no person shall use the tribal logo in a manner inconsistent with this chapter.

(3) Injunction and Civil Penalties.

(a) The Tribal Council may petition the Tribal Court to enjoin a violation of this chapter, or for an order imposing a civil penalty for a violation of this chapter, or both.

(b) All penalties recovered under this section shall be paid into the Tribe’s General Fund and become available for general Tribal Government expenses. [Res. 2020-04-009 § 2, 2020.]
