(1) The Natural Resources Committee may promulgate regulations establishing the following:

(a) Gathering seasons for specific plant material, including open and closed seasons specific to a plant material;

(b) Areas closed to gathering;

(c) Limitations on methods of gathering;

(d) Limitations on the amount of a specific plant material which may be gathered within one day or one season; and

(e) Other measures for the protection and wise gathering of plant material in areas within the Tribe’s jurisdiction.

(2) Before proposing regulations, the Natural Resources Committee shall make an effort to get all available information on the abundance and location of plant and fungus species within areas of the Tribe’s jurisdiction by consulting with appropriate personnel in the United States Fish and Wildlife Service, the United States Forest Service, the Washington Department of Wildlife, the Washington Department of Natural Resources and other appropriate federal or state agencies, as well as Tribal technical staff.

(3) No later than 15 days after it receives proposed regulations from the Natural Resources Committee, the Tribal Council shall either approve or amend and adopt the regulations or refer the proposed regulations back to the Natural Resources Committee with suggestions for changes. If the Tribal Council does not act on the Natural Resources Committee’s recommendations within 15 days, the Committee’s proposed regulations shall be considered approved by the Council and shall take effect immediately or according to their terms.

(4) All regulations promulgated under this section must be posted promptly at a public location in all Samish Tribal government offices and on the Tribe’s website, and must indicate the date and hour they were adopted. [Res. 2020-12-039, 2020.]
