(1) The Tribal Chair may declare a tribal state of emergency if:

(a) A disaster has occurred;

(b) The threat of emergency exists;

(c) An emergency may be imminent that is severe enough to require accelerated change to tribal operations or federal aid to supplement Samish resources in preventing or alleviating damages, loss, hardship, or suffering.

(2) Following a declaration of a tribal state of emergency, the Tribal Council must consider a resolution to ratify and affirm, or reject, the state of emergency.

(3) The resolution should include:

(a) The nature of the emergency;

(b) The political subdivision(s) or geographic area(s) subject to the declaration;

(c) The conditions that have brought about the emergency;

(d) The duration of the state of emergency, if less than 30 days; and

(e) The authority of staff to respond to the emergency. [Res. 2020-05-005, 2020.]
