(1) Any Tribal Council member, Tribal staff, Tribal citizen, or committee member may bring a complaint alleging one or more violations of the standard of conduct contained in STC 2.40.140. Complaints must be written, identify the committee member against whom the complaint is made and detail the alleged violations of conduct under STC 2.40.140 by the committee member. Complaints must be submitted to the committee chair; provided, that if the complaint is made against the committee chair, it must be submitted to the Tribal Council, who will select a provisional committee chair to serve until the complaint has been resolved.

(2) The committee chair must send the complaint to the committee members and hold a meeting to review the complaint within 10 days of its receipt. If the accused committee member fails to meet the standard of conduct, he or she may be removed from the committee. In order to remove a member from the committee, a majority of the rest of the committee must vote to remove the accused member based on specific allegations that the member failed to meet the standards of conduct in STC 2.40.140 or any other applicable Tribal law or regulations. If a committee votes to remove a member, the committee chair must submit a written request to the Tribal Council to remove the member from the committee. The request for removal of a committee member must be in writing, explain the basis for the committee’s request to remove the member and provide the date, time and vote by the committee to remove the member. The committee’s request must be submitted to the Council Secretary with a copy of the request sent to the committee member whose removal is being sought.

(3) A committee member subject to removal is entitled to a hearing before the Tribal Council which provides applicable standards of due process and equal protection prior to the Tribal Council making its decision on the removal of the member. The Council Secretary is responsible for communicating the date and time of the hearing to the committee chair and committee member whose removal is sought. The hearing must be held within 30 days of the committee’s vote to seeking removal of the member; provided, that the member has at least 14 days’ written notice of such hearing. The Council may by motion extend this timeline if circumstance prevent the hearing from being held within 30 days of the vote of the committee.
